JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-10-2015 Petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 420, 120B/34 of the Indian Penal Code.

The prosecution case is that the own brother of the informant Ramakant Singh sold the share of land of the informant which he got after partition in favour of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is bona fide purchaser whereas Ramakant Singh claimed to have sold his own share of land as there is nothing on record to suggest that the land in question was allocated to the informant after partition. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the

Case No. 174 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
