JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-07-2019 This application, for grant of anticipatory bail, arises out of Sheikhpura (Hathiyawan) P.S. Case No. 187/19, disclosing offences under Sections 409 and 420 of the Indian Penal Code.

Allegation as per written report of the informant is that the petitioner, who happens to be Panchayat Sachiv, even after his transfer has not handed over the complete charge and also withdrew an amount of Rs. 9,40,000/- from the account. Submission of learned counsel for the petitioner is that the amount in question has been transferred in the account of ward and so far rest of the amount is concerned, he is ready to pay back the same.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will consider the above submission of learned counsel for the petitioner while disposing the prayer of the petitioner for grant of regular bail and pass an appropriate order, without being prejudiced by this order.

This application is, accordingly, dismissed.
