State counsel excepts notice for respondent nos. 1 to 5.

In the instant application, petitioner has prayed for the following reliefs :- i. For issuance of an order, direction or writ in the nature of mandamus, commanding and directing the respondent authority to pay the 3rd A.C.P. w.e.f. 20.03.2012 to the petitioner.

ii. For grant of all consequential benefits

Patna High Court CWJC No.1347 of 2021(2) dt.17-01-2022 2/2 associated, with grant of 3rd ACP w.e.f. 20.03.2012 including pensionary benefits, if any.

iii. For grant of any other relief or reliefs to which the petitioner may be found entitled in the facts and circumstances of the present case.

Short question for consideration whether the petitioner is entitled to 3rd ACP with effect from 20.3.2012 or not.

In this regard, grievance of the petitioner is pending consideration before the concerned respondents as evident from Annexures- P/2 and P/3 respectively.

The concerned respondent is hereby directed to redress the grievance of the petitioner stated in the representation whether the petitioner is entitled to 3rd ACP with effect from 20.3.2012 or not and pass speaking order and communicate the same to the petitioner within a period of four months from the date of receipt of this order. With the aforesaid observation, the present petition stands disposed of.
