2. The petitioner seeks regular bail in the present case registered for the offences punishable under Sections 448, 323, 324, 307, 302, 120(B) and 34 of the Indian Penal Code.

3. The petitioner is the order-giver. He is 70 years old and is in jail since 04.09.2023.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is next submitted that similarly situated coaccused namely, Ramdeo Singh has been granted bail by this Court vide order dated 28.06.2024 passed in Cr. Misc. No. 27642/2024. Learned counsel further submits that petitioner is a man with a clean antecedent and he is in custody since 28.11.2025. The petitioner undertakes to co-operate in the case/

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the submissions advanced on behalf of the parties as well as the fact that similarly situated co-accused namely, Ramdeo Singh has been granted bail by this Court vide order dated 28.06.2024 passed in Cr. Misc. No. 27642/2024, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-I, Gopalganj /concerned Court below in connection with Phulwariya P.S. Case No. 314 of 2023.

8. As a condition of this order, the petitioner after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the Trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
