Even though the petitioner's claim for compensation under the provisions of the Bihar Electricity Regulatory Commission, Patna Compensation to Victims Of Electrical Accidents Regulations, 2018, stood rejected by the respondents, but however, in terms of our order dated 14.02.2022, the authorities have re-visited their stand and awarded a sum of Rs.4,00,000/- as compensation to the petitioner.
Before us, it is not in dispute that the petitioner's husband died on 20th of September, 2019 as a result of electrocution by way of a live wire. We notice that under the Regulations, the amount quantified in terms of Chapter-3 already stands paid.
As such, in view of the attending facts and circumstances, we close these proceedings, reserving liberty to the petitioner to pursue other remedies, equally efficacious for further amount on all counts, more so in view of the decisions rendered by Hon'ble Apex Court, as reported in (2005) 6 SCC 156, titled as SDO, GRID Corporation of Orissa Ltd. V. Timudu Oram, and (2002) 2 SCC 162, titled as M.P. Electricity Board v. Shail Kumar.
