This application is for grant of regular bail in connection with Lakhisarai (Kabaiya) P.S.Case No.146 of 2017, registered for the offences punishable under Sections 272, 273 & 290 of the Indian Penal Code.
Allegation is of recovery of 300 ltrs. of country-made liquor from the vehicle, in which the petitioners were arrested. Submission of the learned counsel for the petitioners is that they have been falsely implicated in this case and they have no criminal antecedent. The petitioners are in custody for more than four months.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.35869 of 2017 (2) dt.09-08-2017 2/2 circumstances, this application is disposed of with direction to the learned court below that the petitioners may be released on bail in connection with Lakhisarai (Kabaiya) P.S.Case No.146 of 2017 to the satisfaction of Additional District and Sessions Judge-II-cumSpecial Judge Excise, Lakhisarai after completion of six months period in custody.
With the aforesaid observation, this application is disposed of.
