The petitioner apprehends his arrest in Nabinagar P.S. Case No.107 of 2017 registered under Sections 420 and 406 of the Indian Penal Code and under Section 40 of the Bihar Mines Act.

The gist of the allegation is that the petitioner was running brick kiln without having "No Dues Certificate" from the Pollution Board and the license.

Learned counsel for the petitioner submits that the petitioner has already closed his brick kiln in the year 2012. The other accused persons have already been granted anticipatory bail by order passed in Cr.Misc.No.28393 of 2017, Cr.Misc.No.44342 of 2017 and Cr.Misc.No.49271 of 2017.

No.40646 of 2019(2) dt.02-07-2019 2/2 Having considered the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad (Bihar) in connection with Nabinagar P.S. Case No.107 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
