Petitioner apprehends arrest in connection with Narhat (Sitamarhi) P.S. Case No. 404 of 2021 registered for the offences under Sections 8, 20 and 22 of the N.D.P.S. Act. Learned counsel for the petitioner submit that the petitioner is innocent and has falsely been implicated in the instant case. Further, in para 4 of the supplementary affidavit petitioner has stated that the alleged ganja plant has been recovered from the house of one Rajkumar Chaudhary resident of village Rasalpur and not a single house in the village is in the name of the petitioner. It is also stated that the petitioner has no criminal antecedent.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.42637 of 2022(6) dt.19-04-2023 2/2 and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Sessions Judge, Sitamarhi in connection with Narhat (Sitamarhi) P.S. Case No. 404 of 2021 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
