2. The present Criminal Miscellaneous Application has been filed under Section 482 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as "BNSS, 2023") for grant of anticipatory bail to the petitioners who apprehends their arrest in connection with Hussainganj P.S. Case No. 19 of 2025 lodged on 21.01.2025, for the offences punishable under Sections 126(2), 115(2), 109(1), 118(1), 3(5) of the BNS, 2023.
3. As per the prosecution, FIR has been lodged against six named accused persons including the present petitioners
Patna High Court CR. MISC. No.42500 of 2025(2) dt.09-07-2025 2/3 with allegation that they all reached at the house of the informant and started assaulting due to which injury has been caused near the eye. When other family members have come forward, they also assaulted them.
4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel also submits that informant and petitioners both are full brother and partition took place between them in land and house paper was also prepared, but on petty issue, the dispute has arisen and scuffling took place between them.
5. Counsel submits that the criminal antecedent of the petitioners is clean. He further submits that none of the parties are criminal and at the spur of moment, they started sculffling for the land. He further submits that they shall not repeat such act in future.
6. Learned APP for the State opposes the prayer for bail of the petitioners and submits that there is case and countercase between the parties.
7. As such, in the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on
Patna High Court CR. MISC. No.42500 of 2025(2) dt.09-07-2025 3/3 furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of J.M. Siwan, in connection with Hussainganj P.S. Case No. 19 of 2025, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
