2. The present writ petition has been preferred for the following reliefs :-

2/4 "A. For issuance of an appropriate writ order or direction for setting aside the order dated 10-03-2023 (Annexure-10) passed by Additional Collector cum Additional District Magistrate Motihari District-East Champaran in Jamabandi Cancellation Case No- 634/2022-23 whereby Jamabandi No- 298 of village- Khairawa, under Thana No- 182 bearing Thana No- 65, 66, 66, 65, 156, 153,121 & 52, Khesra No- 1031, 742, 743, 1011, 1041, 642, 1137 & 1058 area 16 decimal, 60 decimal, 17 decimal, 26 decimal, 22 decimal, 23 decimal, 23 decimal, 50 decimal total area 2 acre 37 decimal running in the name of petitioners father since more that 60 years and rent receipts are being regularly paid, on the personal petition dated 21-11-2022 of one Binod Kumar son of late Phulena Prasad, resident of village & P.O- Gariba, P.SKalyanpur, District- East Champaran, local In-charge Circle Chhauradano Inspector

3/4 District-East Champaran has been virtually cancelled ignoring the status quo order dated 25-01-2021 passed in Title Suit No3/2020 by learned Munsif Raxaul at Motihari, District- East Champaran which was operating on that date and it has further been directed not to issue rent receipt till disposal of Title Suit No- 3/2020 which is/was related to only Khata No- 66, Plot No-742, area 1 katha 17 dhur pending in the court of learned Munsif Raxaul at Motihari, District- East Champaran and consequently online entry of all plots have been deleted.

B. For issuance of an appropriate writ order or direction directing the respondents to restore the Jamabandi No- 298 of villageKhairawa, under Thana No- 182 bearing Thana No- 65, 66, 66, 65, 156, 153,121 & 52, Khesra No- 1031, 742, 743, 1011, 1041, 642, 1137 & 1058 area 16 decimal, 60 decimal, 17 decimal, 26 decimal, 22 decimal, 23 decimal, 23 decimal, 50 decimal

4/4 total area 2 acre 37 decimal and issue rent receipt and further online incorporate the said lands in Jamabandi No- 298."

3. Learned counsel for the petitioners submit that he shall be availing the remedy of appeal before appropriate authority.

4. Granting such liberty, the writ petition stands disposed of.
