JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 25-06-2018 It appears that on 17.12.2015 time was granted to the petitioner to file substitution petition on account of death of petitioner No.2.

More than 2 1⁄2 years have passed yet the petitioners have not filed any substitution petition. The matter was adjourned as a last indulgence for a week with the direction that if no substitution is filed, the writ petition would be dismissed as incompetent so far as the petitioner No. 2 is concerned and only at the instance of the petitioner No. 1 the case will be considered by this Court.

Patna High Court CWJC No.8471 of 2011 dt.25-06-2018 2/2 Learned counsel for the petitioner submits that he no has instruction from the client and as such he is not aware of the latest position to make any submission whether interest of the petitioners in the present writ petition is still subsisting or not. In view of the above, the writ petition is dismissed as not pressed. However, liberty shall be available to the petitioners in case of any subsisting grievance, to agitate the matter before the appropriate forum/Court in accordance with law notwithstanding the dismissal of the present writ petition.
