2 The petitioner has preferred this application for grant of regular bail in connection with Barachatti PS Case No 1205 of 2022 dated 26.12.2022 registered for the offence punishable under Section 436 of the IPC.
3 As per the prosecution case, the petitioner was caught with one loaded pistol and a mobile phone. 4 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has one criminal antecedent, as stated in paragraph 3 of the bail petition in which he is on bail. The petitioner is in custody in this case since 11.03.2023.
Patna High Court CR. MISC. No.42960 of 2023(2) dt.20-07-2023 2/2 5 Learned APP has vehemently opposed the bail petition of the petitioner.
6 Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of ACJM II, Sherghati, Gaya in Barachatti PS Case No 1205 of 2022 dated 26.12.2022. 7 This application stands allowed.
