This is an application for bail in connection with Khaira P.S. Case No. 183 of 2014, registered for the offences punishable under Sections 147, 324, 342 and 302 of the Indian Penal Code. Allegation against the petitioner is that he assaulted the deceased with Tangi and there is also allegation of assault against other accused persons and it appears from post mortem report that altogether eight injuries were found on the person of deceased and he died due to shock and hemorrhage caused by injuries. Submission of learned counsel for the petitioner is that there is no eye-witness to the occurrence and considering the same other co-accused have been granted bail by this Court, which will appear from Annexure-2 series and he is in custody for five

Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner at this stage. However, this application is disposed of with a direction to the trial court that once charge has been framed in this case he will release the petitioner on bail to his own satisfaction subject to the condition that he will co-operate in trial.
