JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 Petitioner seeks bail in connection with Panapur P.S. Case No. 48 of 2014, S.T. No. 664 of 2016, for the offences punishable under Sections 147, 148, 149, 448, 326, 307, 323, 379, 427 and 302 of IPC and Section 27 of the Arms Act. Allegation against the petitioner is of assaulting the deceased, causing death.

Submission of learned counsel for the petitioner is that he is in custody for more than three years and up till now only two witnesses have been examined.

Heard learned APP also.

Having heard both sides and perused the report, from which, it appears that two witnesses have been examined, considering the allegation, I am not inclined to grant bail to the petitioner.

Since the trial has already been commenced, the learned

No.43692 of 2019(4) dt.28-08-2019 2/2 trial court is directed to expedite the trial and since the petitioner is in custody for more than three years, the S.P.- is directed to produce the witnesses on the next date fixed, so that, the trial may be concluded as soon as possible.
