The petitioner is seeking regular bail in Birpur P.S. Case No. 53 of 2017 registered under Sections 366(A)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that there is an allegation in the F.I.R. that the daughter of the informant, who was aged about 15 years, had gone to Panchmukhi Chawk for some work from where she went missing. It is alleged that the accused persons named in the F.I.R. took away the daughter of the informant by kidnapping with an intention to marry her. Learned counsel submits that the victim girl has made a statement under Section 164 Cr.P.C. and she has stated that she had fallen in love with the son of this petitioner and had married him on 03.05.2017
Patna High Court Cr.Misc. No.36268 of 2017 (2) dt.10-08-2017 2/2 in Simraha Mandir. There is no allegation against this petitioner. Learned A.P.P. for the State opposed the prayer for bail but considering the fact that this petitioner is the father of the boy with whom the victim girl is said to have married, let the petitioner, namely, Ram Murti Singh, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Begusarai in connection with Birpur P.S. Case No. 53 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
