The petitioner seeks bail in a case registered under Sections 304B and 302/34 of the Indian Penal Code. Petitioner who happens to be mother-in-law of the deceased along with other family members are said to have strangulated to death the daughter of the informant over dowry demand.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner has never made any demand and never subjected the deceased to any sort of torture. Allegation levelled against the petitioner is not specific rather general and omnibus in nature.
Patna High Court Cr.Misc. No.49529 of 2018(3) dt.20-09-2018 2/2 Petitioner happens to be mother-in-law of the deceased. Though the deceased is said to have been strangulated by the petitioner and other accused persons, but in the post mortem report doctor has not found any ligature mark on the neck of the deceased. The petitioner has been languishing in custody since 10.06.2018 and husband of the deceased is in custody.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Manjhagarh P.S. Case No. 156 of 2018.
