JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-08-2021 As prayed for, let the learned counsel appearing for the petitioners remove the defect(s), as pointed out by the office, within four weeks of starting of the Court proceeding in physical mode in normal course.

Heard learned counsel for the petitioners and the learned A.P.P. for the State through Video Conferencing. The petitioners apprehend their arrest in connection with Maniyari P.S. Case No. 246 of 2018, registered under Sections 147, 148, 149, 341, 373, 307, 353, 332, 427, 504 and 506 of the Indian Penal Code and Sections 30(a) and 38/41 of

Patna High Court CR. MISC. No.148 of 2021(2) dt.17-08-2021 2/3 the Bihar Excise Act.

The accusation is that on receiving secret information about concealing illicit liquor by Baliram Singh in his Baithka in village Masudpur, the informant along with other police personnel reached there and on search, several bottles containing Indian made foreign liquor in the volume of 670 litre were recovered. When after loading the said liquors in police vehicle proceeded then 150-200 male and female persons surrounded the police vehicle and started to abuse and damaged the police vehicle by pelting stones and also tried to snatched the arms of the police personnel. Thereafter, in self defence, police also fired then mob started to flee away. On query, informant came to know the name of 27 persons including the petitioners out of the said mob.

Learned counsel for the petitioners submits that while petitioners are named in the FIR but no specific overt act has been attributed against them. In fact, petitioners have been implicated in the present case due to dirty village politics at the instance of the local Choukidar.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below

No.148 of 2021(2) dt.17-08-2021 3/3 within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur, in connection with Maniyari P.S. Case No. 246 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
