Petitioner has earlier moved this Court for grant of bail in Cr. Misc. No. 16023 of 2017, which was rejected vide order dated 25.04.2017 (Annexure-1).

On the submission of the learned counsel appearing for the petitioner that the trial is not progressing, this Court vide order dated 29.08.2018 had called for a report from the Court below, which has been received and is kept at Flag "A". Perusal of the report shows that charge has been framed in this case on 25.08.2017 and not a single witness has been examined till date.

Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.49066 of 2018(3) dt.12-09-2018 2/2 specially the slow pace of the trial as also the period of custody of the petitioner, it is directed that let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 6th Additional Sessions Judge, Muzaffarpur in connection with Sessions Trial No. 454 of 2017 arising out of Kudhani (Kurhani) P.S.
