JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 05-08-2015 Learned counsel for the appellant did not want to press instant appeal on merit in the background of the fact that according to his submission appellant Moti Sahni @ Ram Chandra Sahni who has been found guilty for an offence punishable under section 395 IPC vide judgment dated 13.04.2010 and sentenced to undergo R.I. for 10 years as well as fine appertaining to Rs.5,000/- in default thereof, to undergo SI for one month, additionally vide order of sentence dated 16.04.2010 relating to Sessions Trial No.306 of 2005 by the Additional Sessions Judge, FTC-II, Muzaffarpur arising out of Katra P.S. Case No.22 of 2005, happens to be under custody since 09.03.2005 and on account thereof, had already saturated the period of sentence.

That being so, the appellant should be released forthwith if not wanted in any other case.

With the aforesaid direction, instant appeal is dismissed as not pressed.
