The petitioner is in judicial custody since 25.06.2021 in connection with Excise Case No. 272 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 (Amended Act, 2018).

The prosecution case, as stated in the First Information Report is that the Superintendent, Excise, Muzuffarpur and S.I. (Excise) Bhole Shankar Kumar conducted a search in the premises of the petitioner and found 30 liters of 'Chulaai' liquor from his courtyard (Aangan). As per the counsel for the petitioner, it is a common courtyard of the entire family and as such the allegation cannot

Patna High Court CR. MISC. No.51360 of 2021(3) dt.31-03-2022 2/2 be attributed against him. He has further submitted that petitioner is in jail since 25.06.2021 and does not bear any criminal antecedent.

In that view of the matter, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of Special Judge, Excise, Muzuffarpur in connection with Excise Case No. 272 of 2021. The bail application is allowed.
