2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Buxar Muffasil P.S. Case No. 93 of 2025, lodged on 01.03.2025, under Sections 126(2)/115/109 /74/303(2)/ 351 /352/3(5) of B.N.S. Act and under Section / of the Arms Act.
3. As per the prosecution, FIR has been lodged against four named accused persons against whom allegation
Patna High Court CR. MISC. No.42433 of 2025(2) dt.09-07-2025 2/3 is that they have assaulted the nephew of the informant with kicks, shoes and lathi. Specific allegation against the petitioner that he has attacked by iron rod on the head of the informant due to which he sustained injury.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that he has been falsely implicated in this case. He submits that antecedent of the petitioner is clean and both families are well known to each other and only due to revenging attitude case has been filed. Counsel submits that Panchaiyati took place between the parties, thereafter matter was settled down.

Learned APP for the State opposes the prayer for bail of the petitioner and submits that though petitioner is arguing about the Panchaiyati, but there is not single whisper or any supporting document for Panchayat. He submits that specific allegation of assault by iron rod on the head of the informant due to which he sustained injury.
6., Considering the nature of allegation, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail of the petitioner is hereby rejected. However, in the event of surrender of the petitioner
Patna High Court CR. MISC. No.42433 of 2025(2) dt.09-07-2025 3/3 within four weeks from today, the prayer for regular bail shall be considered by the Trial Court after looking the nature of injury without being prejudiced by the order of this Court. (Dr. Anshuman, J) Mkr./- U
