The petitioner seeks bail in connection with Buxar (M) P.S. Case No. 09 of 2017, registered under Sections 395 and 397 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the petitioner was apprehended by the Police mere on suspicion, who got recorded his confessional statement showing his involvement in the present case. As far as recovery of jewellery is concerned, as detailed in the impugned order dated 18.04.2017 passed in B.P. No. 213 of 2017, the same has been recovered to the house of Santosh Sonar, as detailed in para 45 of the case diary, while the petitioner is accused in two cases, but he is on

Patna High Court Cr.Misc. No.27660 of 2017 (3) dt.02-08-2017 2/2 bail in that cases and in the present case he is in custody since 19.02.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Buxar (M) P.S. Case No. 9 of 2017. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
