The petitioner is apprehending his arrest in connection with Kalyanpur P.S. Case No. 23 of 2022 pending in the Court of learned Special Judge, Excise Act-01, Samastipur in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Allegedly, it is a case of recovery of illicit liquor from the house of this petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has got clean antecedent. Learned APP appearing for the State has opposed the

Patna High Court CR. MISC. No.42426 of 2022(2) dt.02-11-2022 2/2 prayer for anticipatory bail.

In view of the fact that the said illicit liquor was recovered from the house of this petitioner, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail stands rejected.
