2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 80 and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that the daughter was married with the son of the petitioner about six years back and after marriage, the petitioner along with the other accused were demanding motorcycle and on account of non-fulfillment of the demand, victim was tortured, further, out of the wedlock, three children were born, next alleges that on 09.01.2024, the informant received an information that her daughter is ill, accordingly, she came to the

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that the marriage of the daughter of the informant with son of the petitioner was performed six years back but no case ever came to be instituted either by the informant or the deceased alleging torture, on account of nonfulfillment of dowry demand. It is also submitted that informant is not an eye witness to the occurrence and the entire allegation hinges around suspicion. It is next submitted that the dead body was found lying in the house, as such, no effort was made by the accused persons to dispose of the dead body with a view to conceal the evidence.

It is next submitted that had the petitioner been involved in the occurrence, in that event efforts would have been made to dispose of the dead body. It is also submitted that whenever any dispute arises in between the husband and wife and the occurrence of the nature as alleged takes place, the entire family members are implicated in a mechanical manner and petitioner being mother-in-law came to be implicated. It is also submitted petitioner will not abscond rather will cooperate in the investigating to prove her innocence.

5. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.42077 of 2025(2) dt.09-07-2025 3/3 anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bhadwar P.S. Case No. 49 of 2024 subject to the conditions as laid down under Section 482 (2) of the BNSS.
