2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Fulwaria (Fulwariya) P.S. Case No. 55 of 2026, lodged on 15.03.2026, under Sections 126(2), 127(2), 115(2), 303(2), 308(5), 308(6) and 3(5) of BNS, pending in the Court of Ms. Saleha Sabiha, Judicial Magistrate, 1st Class, Begusarai.
3. As per the prosecution, the FIR has been lodged against five named accused persons including the present

No.41512 of 2026(2) dt.01-07-2026 2/3 petitioner with allegation that the informant was allegedly asked by the accused Krishna Kumar to come Barauni with Rs. 5,00,000/- for purchasing smack and thereafter all the accused persons allegedly robbed cash, scooty, mobile phone and ATM cards at gunpoint.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that in the FIR name of petitioner has come but he specifically pleaded that in para 17 of the case diary his friend Manish has not disclosed his name. Counsel submits that petitioner is completely innocent and his name has been inserted in this case only at the instance of the informant due to village politics. He submits that the father of the petitioner has also filed an application to the Superintendent of Police, Begusarai, for proper investigation, but in this direction no proper investigation has been made. Counsel submits that the FIR has been lodged after one day. He also submits that the antecedent of the petitioner is clean, but in the said case arms has not been recovered from the possession of the petitioner.
5. Learned Counsel for the State, on the other hand, submits that there is specific allegation in the FIR against the petitioner.

6. In the light of the submission made, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail of petitioner is hereby refused. However, in the event of surrender of the petitioner within four weeks from today, the prayer for regular bail shall be considered on the same day without being prejudiced by the order of this Court.
