JUSTICE SUDHIR SINGH ORAL ORDER 27-01-2016 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are apprehending their arrest in connection with Giriyak P.S. Case No. 129 of 2015 for the offences instituted under Sections 304(B) and 201/34 of the Indian Penal Code.
As per prosecution case, it is a case of murder of the informant's daughter due to non-fulfilment of dowry demand by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner has been made accused due to mistake of fact. Petitioner is separate in mess
Patna High Court Cr.Misc. No.45142 of 2015 (3) dt.27-01-2016 and property from the husband of the deceased. Petitioner no.1 is father-in-law of the deceased and petitioner no.2 is the mother-inlaw of the deceased. The husband of the deceased is in custody. On behalf of the State and the counsel for the Informant, it has been submitted that the petitioners have actively participated in the alleged occurrence.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Giriyak P.S. Case No. 129 of 2015/G.R.No.2262 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
