The petitioner is in custody since 02.05.2017 in connection with Madhepur P.S. Case No. 84 of 2016 for the offence registered under Sections 392, 395, 120(B) and 412 of the Indian Penal Code.
Learned counsel for the petitioner fairly submits that he has been made accused in four cases but in all such cases, he was not named in the first information report and his name surfaced on the basis of the confessional statement by co-accused. In the present case also, the petitioner is not named in the first information report but his name surfaced on the basis of the confessional statement made by co-accused, which has no evidentiary value. Furthermore, there has been no recovery from the petitioner's possession. T.I. Parade has also not been held.
Patna High Court Cr.Misc. No.40618 of 2017 (2) dt.19-09-2017 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., 1st Jhanjharpur, District Maduhbani in connection with Madhepur P.S. Case No. 84 of 2016.
