JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-10-2015 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners apprehend their arrest in connection with Sikty P.S. Case No. 41 of 2015 registered under Sections 147, 148,323, 341, 447, 307 and 504 of the I.P.C. pending in the Court of C.J.M., Araria.
The allegation of informant Mamta Devi is that petitioners and three others entered in her house forcibly and caused injury through butt of the pistol at the head of the informant and she fell down. Her husband and two brother-in-laws were also assaulted at that time.
Learned counsel appearing on behalf of the petitioners submits that due to land dispute and filing the
Patna High Court Cr.Misc. No.42595 of 2015 (2) dt.08-10-2015 2/2 Complaint Case No. 3867 of 2010, the petitioners have falsely been implicated in this case.
Having considered the facts and circumstances of the, I am not inclined to allow the prayer of the petitioners for anticipatory bail.
Accordingly, prayer of the petitioners is rejected with direction to surrender before the Trial Court within six weeks, who will consider the prayer of bail of the petitioners without being prejudiced by this order.
