ANJANA MISHRA ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in custody since 10.04.2015 in connection with a case registered for the offences punishable under Sections 447/341/323/324/307/302//34 of the Indian Penal Code r/w 27 of the Arms Act.
It is submitted that the entire dispute is within the family and on account of such dispute, the petitioner has been named in connection with the present case and is languishing in jail since 2 1⁄2 years. The petitioner submits that he shall at all material times co-operate in the investigation and in the trial which ensue thereafter. He further submits that the petitioner has no criminal antecedent and only on account of family dispute and sudden provocation, the occurrence took place.
Having considered all facts and circumstances of the
Patna High Court Cr.Misc. No.40676 of 2017 (2) dt.19-09-2017 2/2 case and also the period of custody of the petitioner, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge, V, Nawada in connection with Sirdala P.S. Case No. 234 of 2013.
It is also directed that one of the bailors shall be his own blood relatives being mother or father, brothers or sisters. The wife can also be made a bailor.
