2. Petitioner is in custody in a case registered for the offence under Sections 96, 137(2) and 3(5)of the BNS.

3. As per the prosecution case, it is alleged that petitioner had kidnapped the minor daughter of the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that petitioner and informant's daughter were in love affairs with each other. He next submits that from perusal of the statement of victim girl recorded under Section 183 of BNSS, it appears that she at her own sweet will had gone with the petitioner and there is no further allegation of any

Patna High Court CR. MISC. No.40035 of 2025(3) dt.20-08-2025 2/2 wrong act upon the victim by the petitioner. He next submits that petitioner is in custody since 27.07.2025 and has got no criminal antecedent as stated in para-3 of the bail petition.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

Considering all aspects of the case, materials available on record and submission made by learned counsel for the petitioner and also the fact that the informant's daughter (victim) has stated in her statement recorded under Section 183 BNSS that she at her own sweet will had gone with the petitioner and there is no allegation of sexual assault against the petitioner and also the fact that petitioner is under custody since more than one year, let the above named petitioner be released on bail, on his furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gaya in connection with Alipur P.S.
