1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending her arrest in connection with Darbhanga Sadar P.S. Case no.73 of 2025, registered under sections 109, 126(2), 287, 62 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the informant submits that his wife was forcibly stopped by the three named accused persons which included the petitioner herein as also her husband and one Indal Sahni. It is further stated that while Brij Mohan Sahni sprinkled kerosene oil on the informant's wife, Indal Sahni tried to light her up but did not succeed.

4. Learned counsel for the petitioner submits that the petitioner and others have been falsely implicated in the case. Even as per the allegations levelled in the F.I.R., no overt act

Patna High Court CR. MISC. No.43345 of 2025(2) dt.28-07-2025 2/2 has been alleged so far as this petitioner who happens to be a lady having no criminal antecedent is concerned. The cause of false implication of the petitioner is that the sister of Indal Sahni has on an earlier occasion lodged an F.I.R. against the informant of the instant case, the FIR being Annexure-2 to this petition. The petitioner undertakes to cooperate in the investigation/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegation against this petitioner in the F.I.R., no avert having been alleged against this petitioner who happens to be a lady and has no criminal antecedent, it is directed that the petitioner above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Darbhanga Sadar P.S. Case no.73 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga.
