JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the State. Petitioner is accused in Sakara P.S.Case No.127/17 for the offence punishable under Section 414 of the Indian Penal Code and Sections 25(1-B)a/26/35/25 (1 -AA) and 25 (1 -AAA) of the Arms Act.

Counsel for the petitioner submits that there is no recovery from the possession of the petitioner. Petitioner is in custody since 21.04.2017 and similarly situated co-accused, namely, Uday Shankar Sharma and Bipin Kumar have been granted bail by this Court vide orders dated 7.8.2017, 19.9.2017 passed in Cr.Misc. No.34777/17 and Cr.Misc. No.42298/17 respectively.

Considering the aforesaid facts and circumstances of the

Patna High Court Cr.Misc. No.44183 of 2017 (2) dt.19-09-2017 2/2 case and aforesaid submissions, let the petitioner, above name, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M. cum- Sub Judge-XIII, Muzaffarpur, Sakara P.S.Case No.127/ 17 subject to the condition that the petitioner will cooperate in conclusion of the trial and will not tamper, in any manner with evidence or influence the witnesses.
