JUSTICE ARVIND SRIVASTAVA ORAL ORDER 12-12-2017 Heard learned counsels for the petitioner and the State. Petitioner seeks bail in connection with Sour Bazar P.S. Case No. 286 of 2014 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.

Vide order dated 28.03.2017, this case was directed to be listed on filing of an affidavit by the learned counsel for the petitioner with regard to framing of charge.

Learned counsel appearing for the petitioner submits that in this case charge has been framed on 01.11.2017. Copy of the order dated 01.11.2017 has been annexed as Annexure-4 to the supplementary affidavit filed on behalf of the petitioner. Learned counsel further submits that petitioner has falsely been

Patna High Court Cr.Misc. No.1680 of 2017(4) dt.12-12-2017 2/2 implicated in this case. Both the parties are resident of the same village and there is admitted land dispute between them. The coaccused Sachidanand Yadav, against whom there is specific allegation of assault with Farsa, has been granted bail by the Court below.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 286 of 2014, G.R. No. 1613 of 2014 .
