The petitioner seeks regular bail in connection with Rajauli Police Station Case No. 175 of 2017 registered for offences punishable under sections 379 of the Indian Penal Code and Rule 4 & 40 of Bihar Minor Mineral Concession Rules, 1972 and Rule 8 (d) of Bihar Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2003.

It has been submitted that the Police on information, reached near Boudhi Ghat of Dhanarjay River where three-four accused persons had assembled for loading sand on a tractor and seeing the Police party, they started fleeing away. The petitioner was caught by Police merely on suspicion. He has no concern

Patna High Court Cr.Misc. No.43513 of 2017 (2) dt.20-09-2017 2/2 with the sand or tractor. He is in custody since 13.07.2017, having no criminal antecedent.

Considering the facts and circumstances of the case, prayer of bail is allowed and the petitioner-Pintu Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Rajauli Police Station Case No. 175 of 2017.
