JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-07-2019 This is an application for grant of anticipatory bail in connection with Vidyapati Nagar (Ghato) P.S. Case No.147 of 2018, disclosing offences under Sections 392 and 411 of IPC. Prosecution story is that while informant was going along with his driver by his Bolero vehicle by loading cocks, a blue car over take and restrained the way of informant and on the point of pistol got mobile phone and Rs.6000/- cash and also 1832 kg cocks worth at Rs. 1,30,000/-. The petitioner is not named in the F.I.R. and his name was transpired during the course of investigation.

Submission of the learned counsel for the petitioner is that except the confessional statement, there is nothing against the petitioner. He has no criminal antecedent. Heard learned A.P.P. also, who opposed the prayer for

Patna High Court CR. MISC. No.40687 of 2019(2) dt.02-07-2019 2/2 anticipatory bail as the investigation is still going on. Having heard both sides, in view of the aforesaid facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner.
