JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-10-2018 Heard the parties. The petitioner seeks regular bail in connection with Sandesh P.S.Case No. 66 of 2018, registered for the offence under Section 392 of the Indian Penal Code.

Allegation as per F.I.R. is that some miscreants intercepted the informant on the point of gun and snatched away his motorcycle and mobile of the informant and the petitioner has been identified on the basis of his voice.

Submission of the learned counsel for the petitioner is that the petitioner has not committed any offence and he has been falsely implicated in this case and it is not possible to identify the voice and nothing has been recovered from the possession of the petitioner.

Patna High Court Cr.Misc. No.49337 of 2018 (3) dt.03-10-2018 2/2 Heard learned A.P.P. also who opposed the prayer for bail on the ground that some witnesses have also identified the petitioner and he is an accused in six other cases. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. However, the trial Court is directed to expedite the trial.
