JUSTICE RAMESH KUMAR DATTA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and learned Additional P.P. for the State.

The petitioner prays for anticipatory bail in a case under Sections 302, 201 and 34 of the Indian Penal Code. It is submitted by learned counsel for the petitioner that the FIR has been registered after a lapse of one month, i.e., on 3.4.2015, whereas the occurrence is alleged to have taken place on 4.3.2015. It is further submitted that on mere suspicion the petitioner has been roped in this case as she belongs to the family agnates. It is also submitted that similarly situated two accused persons, including the husband of the petitioner, have already been granted bail by this Court by order dated 22.9.2015 passed in Cr.Misc.No. 43746 of 2015.

Patna High Court Cr.Misc. No.43270 of 2015 (2) dt.16-10-2015 On a consideration of the facts and circumstances of the case, it is directed that the petitioner, Gujraiti Devi @ Gujrati Devi, in the event of her arrest/surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Rohtas P.S.Case No. 46 of 2015 to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
