1. Heard learned Counsel for the petitioner, learned Additional Public Prosecutor for the State as well as learned counsel for the informant.
2. This application, for grant of anticipatory bail, arises out of Barachatti Police Station Case No. 234 of 2020 dated 01.05.2020, disclosing offences under Sections 379 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, on 03.04.2020 the informant parked his motorcycle near the house which was found missing on the next day.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of confession statement of the co-accused made during the course of investigation from whose possession the stolen motorcycle
Patna High Court CR. MISC. No.39886 of 2025(3) dt.15-10-2025 2/2 was recovered. Apart from the confessional statement of the coaccused, there is no material available against the petitioner to connect him with the present offence.

Having regard to the rival submissions made on behalf of the parties and taking into consideration the nature of allegation and the statement made against the petitioner during the course of investigation and the fact that the petitioner is having criminal antecedents of similar nature of offence, I am not inclined to grant the petitioner privilege of anticipatory bail.
