JUSTICE SANJAY PRIYA ORAL ORDER 01-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Palasi P.S. Case No. 132 of 2014, instituted for the offence under Section 395 of the Indian Penal Code and Section 3⁄4 of Explosive Substance Act. Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from his possession. No Test Identification Parade has been held. Counsel for the petitioner further submits that petitioner has been made accused merely on suspicion. From CDR it appears that he was seen near the place of occurrence talking with the persons who have been alleged to be accused in the instant case. Petitioner is in custody since 29.06.2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the
Patna High Court Cr.Misc. No.49826 of 2018 (3) dt.01-10-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Araria, in connection with Palasi P.S. Case No. 132 of 2014, subject to the condition that both the bailors will be the close relatives of the petitioner.
