The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, 142.2 litres of liquor was recovered from the house of the co-accused and the three accused persons including the petitioner herein were taken into custody.
It is submitted by learned counsel for the petitioner that from the FIR itself it would transpire that the alleged place of recovery is the house of co-accused and the petitioner has no concern either with the seized liquor or with the house in question. The petitioner is in custody since 10.7.2021 and has no criminal antecedent under the Bihar Prohibition and Excise

Having heard learned counsel for the parties and taking into consideration the petitioner being in custody for over 7 months and not having any criminal antecedent under the Bihar Prohibition and Excise Act, 2016, the petitioner is directed to be enlarged on bail in connection with Town (Begusarai) P.S. Case no. 429 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge - cum - Special Judge, Excise Act, Begusarai.
