The petitioner has preferred this application for grant of regular bail in a case registered under sections 366 and 34 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that the petitioner and others kidnapped his daughter. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The daughter of the informant was recovered and she was medically examined wherein the doctor has opined her to be a major. Further her statement was recorded under section 164 Cr.P.C wherein she has categorically stated that she married the petitioner out of her own free will and wants to live with him.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the material that has transpired in course of investigation specially the report of the doctor together with the statement of the daughter of informant under section 164 Cr.P.C and the petitioner having remained in custody for 1 year 6 months, the Court directs the petitioner to be enlarged on bail in connection with Bachhwara P.S. Case no. 179 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
