2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 354, 307, 504/34 of the Indian Penal Code.
3. Petitioner is said to have assaulted the father of the informant by means of lathi on his head causing injury on his head.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is case and counter case between the parties. He submits that there is no specific overt act against the petitioner. He submits that similarly situated co-accused has already been granted bail by a coordinate Bench of this Court vide order dated 19.02.2024 passed in Cr. Misc. No. 8217 of
Patna High Court CR. MISC. No.43800 of 2024(2) dt.02-08-2024 2/2 2024. He further submits that petitioner has criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 29.03.2024.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the cas, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sahiyara P.S. Case No. 50 of 2020.
