The Petitioners seek regular bail in connection with Suryapura P.S.Case No. 16 of 2018, registered for offences punishable under Sections 363 and 365 of the Indian Penal Code. As per F.I.R. allegation against the petitioners is of kidnapping the minor daughter of the informant. Submission of the learned counsel for the petitioners that the petitioners have falsely been implicated in this case and whole allegation alleged in the F.I.R. are false. It is further submitted that during course of investigation it appears that one co-accused, Vikash Kumar has taken the victim girl by the
Patna High Court Cr.Misc. No.49401 of 2018 (4) dt.03-10-2018 2/2 tempo of the petitioner No. 1 and left the victim in the house of petitioner No. 2 and girl is still traceless. It is further submitted that the petitioners are in custody since 21.04.2018 Heard learned A.P.P also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Suryapura P.S.Case No. 16 of 2018, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. and ii) The petitioners shall cooperate with the police during investigation and they will not induce any witness or tamper with the evidence.
