JUSTICE SANJAY PRIYA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Khaira P.S. Case No. 117 of 2017 instituted for the offence under Section-34(B) of Bihar Prohibition and Excise Act, 2016.

It is alleged that police on the confidential information that foreign liquor is being brought in huge quantity by the container/truck from Haryana which is being unloaded outside the house of this petitioner, the police reached there and seeing the police party, people fled away but on chase by the police, three persons were apprehended and they disclosed their names as Subhash Rai, Laxman Rai and Bhavnath Rai. It is further alleged that the aforesaid container was loaded with huge quantity of foreign liquor as mentioned in the written report, which was to be unloaded in the house of this petitioner as appears from the seizure list. As such there is specific allegation that huge quantity of foreign liquor was brought by the petitioner from Haryana for business purpose.

Patna High Court Cr.Misc. No.37897 of 2017 (2) dt.09-08-2017 Therefore, this court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail is rejected. The petitioner is given liberty to renew his prayer for bail after six months, if no substantive progress is made in the case in the court below.
