2. The petitioner apprehends her arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 03 litres of illicit country made liquor has been recovered from the house of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. She further submits that the alleged house of the petitioner is without any door and window and is still under construction and as such it is accessible to one and all. Nothing

Patna High Court CR. MISC. No.41054 of 2025(2) dt.02-07-2025 2/2 incriminating has been recovered from conscious possession of the petitioner. Petitioner is a lady having clean antecedent.

5. Learned APP for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, quantity of recovery, clean antecedent and also the fact that the petitioner is lady, let the petitioner, abovenamed, in the event of her arrest / surrender before the learned trial Court within a period of eight weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise-3, Gaya in connection with Bodhi Bigha P.S. Case No. 10 of 2025, subject to the condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S., 2023.
