Petitioner seeks bail in a case registered for the offences punishable under Section 394 of Indian Penal Code. The FIR of the occurrence of robbery of mobile phone is against unknown.

Submission is that after one year of the occurrence, one mobile phone was seized from the possession of the petitioner which was said to be a looted property. Petitioner is in custody since 01.09.2020. He has got no criminal antecedent. Investigation of the case is already complete. In fact the mobile phone was second hand purchase by the petitioner. Considering the lack of material, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of

Patna High Court CR. MISC. No.38602 of 2020(3) dt.19-03-2021 2/2 learned Court below where the case is pending in connection with Ara Nawada Police Station Case No.868 of 2019 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
