The petitioner seeks bail in Naubatpur P.S. Case No. 28/2018, instituted for the offences under Sections 499 and 402 of the Indian Penal Code read with Sections 25(1-b)A, 26 and 35 of Arms Act.

Learned counsel for the petitioner has submitted that one loaded country made pistol and one live cartridge have been recovered from possession of this petitioner. It is further submitted that other co-accused with similar allegation has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 39126/2018 dated 05.07.2018.

Petitioner is in custody since 26.01.2018.

Patna High Court Cr.Misc. No.58429 of 2018 (3) dt.06-11-2018 Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate IInd, Danapur, Patna in connection with Naubatpur P.S. Case No. 28/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
