2. The petitioner is in judicial custody in connection with NTPC P.S. Case No. 125 of 2022 for the offence punishable under Sections 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code lodged on 01.11.2022 by the informant, Kanhaiya Kumar.

3. As per the prosecution story, the informant alleged that on 01.11.2022, the informant had gone to purchase grocery when the accused persons assaulted and on the threat of pistol took away 5 grams of gold chain and also Rs.500/- from the pocket. Accordingly, the FIR.

4. Learned counsel for the petitioner submits that due to village politics, he has been named. No such occurrence took place.

5. Learned APP on the other hand opposes the prayer and submitting that not only he has criminal antecedent, even after lodging of the present case in the year 2022, he committed another crime vide NTPC Case No. 125 of 2023, as per the para-3 of the petition.

6. Taking into account the aforesaid facts that one more case came to be lodged against him after the present case, for the present, this Court is not inclined to extend him the privilege of bail which is accordingly rejected.

7. The petitioner may renew his prayer for bail after framing of the charges.
