The petitioner apprehends his arrest in connection with C.R. Case No.284 of 2019 for offences under Sections 341, 323, 379, 498A and 504, 120(B) of the Indian Penal Code. Both the parties submit that the matter has been settled. The petitioner has agreed to pay a sum of Rs.7,00,000/- (Rupees seven lakhs) as amount of one time settlement to the opposite party no.2.

Learned counsel for the petitioner submits that the petitioner is ready to pay Rupees one lakh at the time of

Considering the above, this application for anticipatory bail is allowed.

Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on provisional bail for a period of six months, on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Benipatti, Madhubani in connection with C.R. Case No.284 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The court below will grant provisional bail when he surrenders and prays for regular bail and while accepting the bail bond, the petitioner will produce demand draft of Rs.1,00,000/- in the name of opposite party no.2. Thereafter the petitioner shall be released on provisional bail for a period of six months. After the entire amount is paid, provisional bail granted to the petitioner shall be confirmed. If the petitioner defaults in payment of the amount as mentioned above, his bail bond shall be cancelled and he shall be taken into custody. In case the entire amount is paid by the petitioner, opposite party no.2 will

With the aforesaid observation and direction, this application is allowed.
