The petitioner seeks bail in Chapra Muffasil P.S. Case No. 142 of 2020 (UT No. 174 of 2021), registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of the Arms Act. As per the prosecution case, six persons including this petitioner were apprehended from an orchard and from possession of co-accused Satya Prakash Singh @ Godhan one country made pistol and three live cartridges were recovered and one knife from another co-accused.
It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. No arms and ammunition has been recovered from possession of this
Patna High Court CR. MISC. No.52530 of 2021(3) dt.21-01-2022 2/2 petitioner. Petitioner is in custody since 14.02.2021. Investigation is complete.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Chapra, Saran in connection with Chapra Muffasil P.S. Case No. 142 of 2020 (UT No. 174 of 2021).
